Spousal Visa & Sponsorship – Canada

Under this visa, Canadian residents can sponsor their spouse, parents, dependent children dependent grandchildren or dependent grandparents and furthermore gain permanent residence in Canada.

There is a sub-category of the Family Class immigration that is Spousal Sponsorship program which allows citizens and permanent residents of Canada to sponsor their spouse or common-law partner for Canadian permanent residency.

The sponsor and applicant must demonstrate their relationship to be one of three categories to receive a Spouse Visa through this immigration program:

  • Spouse
  • Conjugal Partner
  • Common-law Partner

It is necessary to be approved by Citizenship and Immigration Canada (CIC) to receive the Spouse Visa for Canada.

NOTE: Same-sex partners are eligible to apply under this category as Canada recognizes same-sex marriage and they should meet all eligibility requirements.

Eligibility requirements for the Sponsor -

  • The sponsor The sponsor must be 18 years of age or above
  • The sponsor must be a citizen or permanent resident of Canada
  • The sponsor should not have been in prison, be bankrupt, under a removal order (in case of a permanent resident) or have charged with a serious offence.
  • The sponsor should not have been sponsored to Canada as a spouse within a span of last five years.

Sponsor cannot be qualified if:

  • The sponsor have failed to provide financial support to a previously sponsored commitment,
  • The sponsor is under the age of 18 years,
  • The sponsor was already married to someone else at the same time of their marriage to the applicant,
  • The sponsor have lived separately and one of the two has been in a relationship with a third person along with conjugal or common-law,
  • The sponsor have immigrated to Canada, but was not examined by CIC, and
  • The sponsor has an existing sponsorship agreement which stands valid at the time of filing another sponsorship application to CIC.

After Sponsorship

The Spousal Sponsorship program includes rules and regulations granted as follows:

  • After the applicant has gained a permanent residence in Canada, the sponsor must be financially strong to sponsor the applicant, for a minimum period of three years.
  • Post receiving their permanent residency in Canada, spouses are not allowed to sponsor a spouse in turn for five years those who go to the Canadian state.
  • Two-year legal relationship regulation is needed for the Spouses/partners who have been in a relationship for two years or less and who bear no children in common with their sponsor at the time of submitting the application. If the candidate is living with his/her spouse/partner in a lawful relationship for a minimum of two years in Canada, or are subject to facing the possibility of having their Permanent Residency revoked.
  • Exceptions are there to these rules and regulations for Sponsored spouses or partners who face abuse or neglect.
